Disability discrimination against third parties
In EBR Attridge LLP and another v Coleman (No2) [2009], the Employment Appeal Tribunal (EAT) held that disability discrimination includes scenarios where employees are discriminated against by reason of a third party's disability (known as 'associative discrimination').
Ms Coleman claimed that her employer directly discriminated and harassed her on the grounds of her son's disability, to whom she was the primary carer.
The EAT held that the Disability Discrimination Act 1995 protects employees of associative discrimination.
